MOBILE APP PRIVACY NOTICE
Effective Date: April 14, 2024
Informed Medical LLC (the “Company” or “we/us/our”) respects the privacy of your Personal Information, and is committed to protecting it through our compliance with this Privacy Notice (“Notice”). This Notice applies to our mobile application (“App”) and associated services (the App and associated services, collectively, the “Services”), and describes:
- The types of Personal Information we collect about you or you may provide when you download, register with, or access the App and otherwise use the Services.
- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Notice applies only to Personal Information we collect in this App and in electronic communications sent through or in connection with the App and the Services.
This Notice does not apply to information that:
- We collect offline or on any other Company apps or websites, including websites you may access through the App.
- You provide to or is collected by any third party.
Our websites and apps, and these other third parties, have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this Notice, and our Terms of Use for the Services, which together form the “User Agreement” and govern your use of the Services. By downloading and registering on the App and otherwise using the Services, you agree to be bound by the User Agreement. If you do not agree, do not download or register with the App, or otherwise use the Services.
- What is Personal Information?
“Personal Information” is information that relates to an identified or identifiable individual. It does not include de-identified, publicly-available, or aggregated information. As used in this Notice, “Personal Information” is limited to information that we collect through the App or when you otherwise use the Services.
- Personal Information We Collect, and How We Collect It
We collect Personal Information about you (1) from you, when you directly provide it to us; (2) automatically, when you use the Services; and (3) from third parties, as described in this Notice.
- Personal Information You Directly Provide To Us
When you register for a user account for the Services (“Account”), we will ask you for your:
- Full name
- Login credentials that you create (username and password)
- Job title
- Medical specialty or practice area
- Provider affiliation
- Business email address
- Telephone number
- Photo for your profile
- Answers to account security questions
- Records and copies of your correspondence, if you contact us or others through the App.
- Personal Information We Collect Through Automatic Data Collection Technologies
When you use the App, it may use technology to automatically collect:
- Details of your access to and use of the App, including communication data and the resources you access or use on or through the App.
- Information about the mobile or other device you use to access the Services (your “Device”) and internet connection, including IP address or other unique identifier, operating system, browser type, mobile network information, and telephone number.
- Metadata and other information associated with other files stored on your Device.
The App does not collect real-time information about the location of your Device.
The technologies we use for automatic collection may include “cookies.” A cookie is a small file placed on your Device. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone or browser. However, if you select this setting you may be unable to access certain parts of our App.

- Personal Information We Collect From Third Parties
We may collect Personal Information about you from others who use the Services, such as when they submit information to us about you for purposes of collaborating on a patient. Additionally, we may, from time to time, supplement the Personal Information we collect directly from you on the App and through the Services with information from third parties for various purposes, including to verify you are associated with a particular provider, enhance our ability to serve you, tailor the Services to you, and offer you opportunities that may be of interest to you. To the extent we combine information we receive from those sources with the Personal Information from you, it will be treated as Personal Information and we will apply this Notice to such combined information, unless we have disclosed otherwise. In no other circumstances do our statements under this Notice apply to information we receive about you from third parties.
- Online Tracking
We do not collect Personal Information about your online activities over time and across third-party websites or online services.
When you use the Services, certain third parties may use automatic information collection technologies to collect information about you or your Device. These third parties may include:
- Your Device manufacturer
- Your mobile service provider
- Etica Inc. d/b/a HIPAA Vault, our secure hosting service for patient information
We do not control these third parties' use of tracking technology with non-patient information. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
- How We Use the Personal Information We Collect
We use Personal Information that we collect about you:
- For our business/operational purposes
- Helping to ensure security and integrity.
- Debugging to identify and repair errors that impair existing intended functionality.
- Short-term, transient use, including non-personalized advertising shown as part of your current interaction with us.
- Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on our behalf.
- Providing advertising and marketing services (except for cross-context behavioral advertising) to you.
- Internal research for technological development and demonstration.
- Verifying or maintaining the quality or safety of—or improving, upgrading, or enhancing—a service or device owned by, manufactured by, manufactured for, or controlled by us.
- For our commercial purposes
- Providing, maintaining, personalizing, and improving the Services.
- Sending system notifications and activity notifications via push notifications on the App.
- Sending administrative communications, such as about operational changes or updates, new feature releases, new user updates, and content sharing notifications.
- Investigating and enforcing compliance with the User Agreement.
- Verifying and validating your identity, or otherwise preventing, investigating, or providing notice of fraud, unlawful or criminal activity, or unauthorized access to or use of Personal Information and our Services.
- Complying with our legal obligations, including complying with law enforcement or governmental authority requests, participating in judicial proceedings, responding to requests from third parties based on their legal rights, and investigating fraudulent activity.
- Enforcing and defending our legal rights and those of our employees, affiliates, and agents.
- Providing you with newsletters, articles, product or service alerts, new product or service announcements, and other information.
- Including you in market research and surveys.
- Keeping a record of our interactions with you.
- Enabling you to interact with content service providers, whether by linking to their sites, viewing their content within our online environment, or viewing our content within their online environment.
- Creating aggregated, pseudonymized, or anonymized information for analytical and statistical purposes.
- Engaging in corporate transactions requiring review of user records.
- Maintaining insurance policies and coverage
- As permitted by applicable law.
- In any other way we may describe when you provide the information.
- Fulfilling any other purpose for which you provide it.
- For any other purpose with your consent.
- How We Disclose Your Personal Information
We may disclose aggregated and/or de-identified information about our users to third parties without restriction.
We may disclose your Personal Information to third parties:
- For the purposes for which you provided it.
- To the provider with which you are affiliated.
- To contractors, service providers, and other third parties we use to support our business.
- To our affiliates.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information is among the assets transferred.
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- As we believe necessary or appropriate to protect the rights, property, or safety of us, our customers, or others.
- For any other purpose we disclose when you provide it.
- With your consent.
- how you can Access Your Personal Information
You can review and change your Personal Information by logging into the App and visiting your Account profile page. You may also contact us using the methods in Section 14 to request access to the Personal Information we have collected about you over the past twelve (12) months.
At your verifiable request, and as permitted or required by and consistent with applicable law, we will confirm whether we are processing Personal Information about you, and provide copies of the Personal Information we have collected about you over the past twelve (12) months. We may limit your access requests to a reasonable number per year. Unless prohibited by applicable law, we may charge a fee for responding to access requests. We will notify you in advance of any fee.
We may refuse or delay an access request under certain circumstances, such as to protect legal privilege, to safeguard proprietary information, to protect the privacy rights of others, at the request of law enforcement, or to prevent undue burden or expense. If we determine that we cannot fully and promptly respond to an access request, we will tell you why and, if possible, work with you to modify the request so we can respond.

You are responsible for the accuracy and completeness of the Personal Information you provide to us. You can review and change your Personal Information by logging into the App and visiting your Account profile page. You may also contact us using the methods in Section 14 to request correction. We will take reasonable and appropriate steps to minimize inaccuracies in your Personal Information, and will correct inaccurate Personal Information at your verifiable request.
- how long we keep your personal information
We will keep your Personal Information as long as your Account is active, as necessary to provide you with the Services. We will also keep and use this information as necessary for the purposes set out in this Notice and to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect our legal rights.
We may also collect and/or create aggregated, anonymized, or pseudonymized information, which we may keep indefinitely.
- Data Minimization
We will take reasonable and appropriate steps to limit the Personal Information we collect, use, and disclose to the type and amount necessary, adequate, and relevant for the purposes for which we process it.
- Children’s Privacy
The Services are intended and configured for use only by healthcare providers (adults). As such, we do not knowingly collect personal information from individuals younger than 18. If you are a parent or guardian and you are aware that your minor child has provided us with personal information, please contact us so that we can take necessary action to delete it.
- Security of Your Personal Information
We have implemented measures to help protect your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.
Unfortunately, no method of transmitting information over the internet or storing it electronically is 100% secure. Neither we nor anyone else can—and we do not—guarantee the confidentiality, security, integrity, or availability of any Personal Information transmitted to or from us over the Internet and/or stored electronically. In all situations, you should carefully consider whether and how to provide Personal Information to someone else (including us). All transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
Access to Personal Information at the Company is limited to workforce members who need it to do their job.
- Unauthorized Uses and Disclosures of Personal Information, and Security Incidents
If we discover an unauthorized use or disclosure, or a security incident, involving your Personal Information, we will promptly assess our responsibilities under applicable law and take all required actions.
- Disputes
You agree that law of the State of California (without regard to conflict of laws) applies to all disputes arising out of or based on the User Agreement and your use of the Services. All such disputes are subject to binding arbitration by a United States Arbitration & Mediation (“USA&M”) neutral according to the USA&M Rules of Arbitration. The arbitrator’s decision shall be final and binding, and judgment may be entered on it. If a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with arbitrator’s award, the other party is entitled of costs of suit including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.
- Changes to This Notice
We may update this Notice from time to time. If we make material changes to how we treat users’ personal information, we will notify you by email to the email address specified in your Account. The date the Notice was last revised appears at the top of the page. You are responsible for ensuring we have a current and deliverable email address for you, and for periodically visiting this Notice to check for any changes. Continuing to use the Services after a change means you accept the change.
